PROBLEM TO BE SOLVED: To provide an optical disk device and an optical disk discriminating method that can easily find out the kinds of optical disks which have different modulating degree in the push-pull tracking error signals. SOLUTION: This optical disk device has a means to generate a push-pull tracking error signal depending on an optical reception signal outputted by an photodetector, and moves the objective lens a prescribed distance in the radial direction on the optical disk after pulling in the focus servo signal. At this time, the disk of small modulation makes a larger change before and after moving the objective lens in the amplitude balance of the push-pull tracking error signals among the disks different in modulation.
