PURPOSE: A spare area assigning method of an optical recording medium is provided to expand to a supplementary spare area even though the size of the supplementary spare area to be expanded is smaller than a preset increment, thereby increasing system performance without infinitely expanding the spare area. CONSTITUTION: A device determines a maximum permissible size. The device decides whether data is previously recorded within the determined maximum permissible size. The device determines the assignable size of a spare area according to decided results. If data is previously recorded within a maximum permissible spare area, the device determines up to the recording position of final data as an assignable size. The device decides whether an additionally assignable spare area can be obtained. If so, the device expands the spare area again within the maximum permissible size.
