PROBLEM TO BE SOLVED: To provide a data transmitter and data receiver which are free from causing overflow or underflow of received data. SOLUTION: The data transmitter for attaching a flag F denoting duplicate reproduction and permission of abolition of audio data (121, 122, ..., 12n) to the audio data and transmitting the resulting data, sets the flag to be 'effective' only when the audio data have a prescribed level or below and are consecutive for a prescribed time or over. The data receiver applies duplicate reproduction to the data whose flag is effective when a received buffer storage amount is a first reference value or below and applies abolition processing to the data whose flag is effective when the received buffer storage amount of the data receiver is a second reference value or over.
