PROBLEM TO BE SOLVED: To provide a fixing device and an image forming apparatus which have short start-up time and are free of an abnormal image in particular even in oilless color fixation. SOLUTION: The fixing device is equipped with a pressing member, an endless belt member suspended around the press member, and a pressure member which faces the pressing member across the belt member to form a nip, and is further equipped with a heating means which heats the belt member or pressure member. A recording sheet carrying a toner image is transported to the nip and passed through the nip to heat, fuse and fix the toner image on the recording sheet. The pressing member 3 freely swings on a fulcrum A for holding, and the fulcrum A of the pressing member 3 is at a position where the pressing member 3 swings to the pressure member 1 in a stronger pressing direction so that a press surface increases.
