PROBLEM TO BE SOLVED: To provide a surface emission laser element of good temperature characteristics for a high output operation, along with an optical transmitter using the same, and to provide an optical transceiver and an optical communication system. SOLUTION: A lower-part semiconductor multilayer film reflection layer 3, a lower-part clad layer 4, an active layer 5, and an upper-part clad layer 6 are laminated on an n-type substrate 2. An upper-part semiconductor multilayer film reflection layer 7 is provided on the upper-part clad layer 6, and a current constricting layer 8 is provided at a part of the p-type upper-part semiconductor multilayer film reflection layer 7. A semiconductor layer laminated above the upper-part region of the lower-part semiconductor multilayer film reflection layer 3 and the lower-part clad layer 4 is formed in mesa-post. By using such semiconductor material as containing TI for a high-refractive index layer constituting the upper-part semiconductor multilayer film reflection layer 7 on an optical exit side, the differential value between the refractive index of the high-refractive index layer and that of the low-refractive index layer is reduced as a temperature rises, relaxing or settling the drop of slope efficiency.
