PROBLEM TO BE SOLVED: To insert an I frame into data to be transmitted as needed in order to prevent error propagation.

SOLUTION: In step S71, it is judged whether an RR packet or an APP packet is received or not. When it is judged that the RR packet or the APP packet is received, in step S72, it is judged whether or not a refresh instruction is contained in the received RR packet or APP packet. When it is judged that the refresh instruction is contained, in step S72, encoding is controlled to generate the I frame. The I frame is then transmitted by an RTP packet, processing is returned to step S71 and succeeding processing is repeated. The present invention can be applied to a data transmitting apparatus.
