PURPOSE: A fabrication method of a dual recording layer optical disk is provided to form land/groove patterns or pit patterns on a spacer layer for separating the first recording portion from the second recording portion comprised of one disk, thereby easily performing a process and increasing a recording density. CONSTITUTION: A material layer for forming a spacer is deposited on the first recording layer(43) formed on a substrate(41) where a pre-pit of the first recording portion is formed. A surface processing layer having lubrication properties is formed on a surface of a stamper. The spacer is formed by patterning the pre-pit for the second recording portion by using the stamper, and the spacer is solidified. The solidified spacer is separated from the stamper by using the lubrication properties of the surface processing layer, and the second recording layer(47) and a protective layer(48) are formed on the spacer.
