PROBLEM TO BE SOLVED: To provide a color toner and a developer excellent in low temperature fixability, having satisfactory anti-offset properties even in a fixing method in which a fixing roller is not coated with release oil or coating weight of oil is made very small, and excellent also in storage stability and transferability, and to provide a fixing method using the toner and excellent in low temperature fixability and anti-offset properties. SOLUTION: The electrostatic charge image developing toner is obtained by dissolving or dispersing, in an organic solvent, a toner composition comprising a binder resin comprising a modified polyester resin capable of reacting with active hydrogen and a low molecular resin having a weight average molecular weight of 2,000-10,000, a colorant and a release agent, forming the resulting solution or dispersion into particles in an aqueous medium, bringing the particles into a polyaddition reaction, removing the solvent from the resulting dispersion, and carrying out washing and drying. A glass transition temperature (Tg) of the toner binder resin is 35 to <55°C and fine particles having an average particle diameter 0.002-0.2 time the average particle diameter of the toner are embedded in the toner surface in the particle shape.
