PROBLEM TO BE SOLVED: To obtain an optical scanner which enable a uniform spot diameter to be obtained on a surface to be scanned even if an oscillating mirror is deformed during the operation, and which enable high definition image recording to be performed free of uneven density, in a system in which an oscillating mirror by silicon micro machining is used for a deflector, and an image forming apparatus. SOLUTION: The optical scanner is equipped with a light emitting source, a first image-forming optical system which converts optical beams from the light emitting source into a prescribed converged or diverged state, an oscillating mirror which, reciprocating with a torsion beam as a rotary shaft, scans the optical beams, and a second image-forming optical system in which an image is formed on a surface to be scanned with the optical beams scanned by the oscillating mirror. In this optical scanner, the image-forming position of the optical beams is varied from the surface to be scanned in accordance with the dynamic deformation of the oscillating mirror. The first image-forming optical system is equipped with a means for varying the image forming position, a means for periodically varying the converged state or the diverged state of the optical beams.
