PURPOSE: A mobile communication system and an overload preventing method thereof are provided to reduce network load in measuring an ROT and transferring it to a channel card. CONSTITUTION: A BUDA(Base station sector conversion and Up/Down converter Assembly)(27) converts digital and analog signals. An RCP(Radio and Channel Processor)(28) controls a channel card(29) and the BUDA and other RF equipments. An interference level measuring unit(22) estimates an interference level(namely, ROT(Rise Over Thermal)) of a signal transferred from a receiving processor(21) of the BUDA(27). An interference level processor(23) compares the measured interference level with an interference level previously transmitted to the channel card(29), and transmits a result value to the channel card(29) if the result value corresponds to the interference level. A comparing unit(24) compares the result value with a certain threshold value to compare load of a reverse link. A transmission data rate increase/decrease information and transport channel determining unit(25) determines transmission data rate increase/decrease information(namely, RAB(Reverse Activity Bit)) received from MSs(Mobile Station) to determine a position of each MS according to the RAB positions in a channel slot. A transmission processor(26) modulates a transmission signal received from the transmission data rate increase/decrease information and transport channel determining unit(25) and transmits it to the MSs.
