PROBLEM TO BE SOLVED: To obtain a norbornene based ring opening polymer which has relatively small birefringence, and unusual wave dependence on the birefringence, and is excellent in transparency and heat resistance. SOLUTION: This polymer comprises a structural unit (1) represented by formula (1) [wherein (m) and (n) are each an integer of 0-2; X<SP>1</SP>is ethylene group or vinylene group; R<SP>1</SP>and R<SP>2</SP>are each hydrogen atom, a substituted or unsubstituted 1-30C hydrocarbon group; R<SP>3</SP>is a formula (1-1) group or a formula (1-2) group of the structure unit (1); in formulas (1-1) and (1-2), R<SP>11</SP>, R<SP>12</SP>, R<SP>13</SP>, ... R<SP>25</SP>, R<SP>26</SP>, and R<SP>27</SP>are each hydrogen atom, a halogen atom, oxygen atom, sulfur atom, a polar group or a substituted or unsubstituted 1-30C hydrocarbon group which may have a bonding group containing or not containing nitrogen atom or silicon atom; in formula (1-1), (p) and (q) are each 0 or a positive integer, and when (p) and (q) are both 0, R<SP>12</SP>and R<SP>15</SP>or R<SP>19</SP>and R<SP>15</SP>may together bond to form a carbocycle or a heterocycle, and the carbocycle or the heterocycle may be of a single cyclic structure or of a polycyclic structure; in formula (1-2), (s) is 0 or a positive integer].
