PROBLEM TO BE SOLVED: To provide a shearing device and a shearing method for obtaining a sheared body of excellent yield in a substantially uniform state by using a material to be sheared. SOLUTION: A material passage 15 of a shearing device A to form a sheared body 27 by moving a material 25 to be sheared to a material extrusion port 14a from a material feed port 13a by the pressure of a pressure punch 23 comprises a material feed passage 13, and a material extrusion passage 14 communicated with the material feed passage 13 at an angle of 90°. A section orthogonal to the moving direction of the material 25 in the material feed passage 13 and the material extrusion passage 14 is formed in a rectangular shape in which the length in the direction along the ridge portion 16a of a corner part 16 of the material feed passage 13 with the material extrusion passage 14 is larger than the length in the direction orthogonal to the ridge portion 16a.
