PROBLEM TO BE SOLVED: To achieve high density recording while preventing overlap between recording units. SOLUTION: Data recording is performed optically for a track 112 of an optical disk 9 having a spiral type track 112 of a pitch Pt and having a plurality of side plane recording layers 122, 123 piled holding an intermediate layer 124 having a refractive index (n) and thickness (t) between them through an objective lens 121 having the number of openings NA and the intermediate layer 124.
