PROBLEM TO BE SOLVED: To comply with the operation rule of transmission while preventing underflow of an output buffer for regulating a generated coding rate and a coding rate to be outputted to a transmission line. SOLUTION: A moving picture coding device is provided with a coding means for coding an inputted video signal for every block of a fixed area in a picture, a storage means for storing coded data at least for one picture coded by the coding processing means, and a rate control means for controlling the coding means, which controls so that it decides whether or not the stored coded data exceeds prescribed filled quantity when the coded data are stored in the storage means, and re-codes the video signal by a prescribed coding method so that the stored coded data exceeds the prescribed filled quantity and intervals of pieces of encoded data which are continuous in terms of time become equal to or less than prescribed intervals.
