PROBLEM TO BE SOLVED: To provide an optical element, such as a diffraction optical element whose phase mismatching part is small in area and which has high diffraction efficiency, by molding and an optical system equipped with the diffraction optical element. SOLUTION: The method for forming the optical element is a method for manufacturing an optical element having a desired uneven pattern on its surface and includes a 1st stage for forming recessed parts and projection parts on a surface of a base material at nearly the positions with recessed parts and projection parts of the desired uneven pattern and a 2nd stage for transferring the desired uneven pattern by positioning and pressing a molding die having a die surface of the reverse shape of the desired uneven pattern to the base material having the recessed parts and projection parts formed at the 1st stage so that the recessed parts of the die surface are almost matched with the positions of the projection parts of the base material formed at the 1st stage and the projection parts of the die surface are almost matched with positions of the recessed parts of the base material formed at the 1st stage.
