PROBLEM TO BE SOLVED: To provide an upper surface emission type light emitting device wherein a positive electrode formed on the upper side of an organic compound layer is implemented as a light take-out electrode, in an active matrix light emitting device. SOLUTION: The light emitting element comprising a negative electrode, the organic compound layer and the positive electrode is characterized by comprising a protection body formed on a boundary face between the positive electrode serving as the light take-out electrode and the organic compound layer. The transmission factor of a protection body formed on the organic compound layer is 70 to 100%, and the protection body prevents damage applied to the organic compound layer when the positive electrode is deposited by a sputtering method.
