PROBLEM TO BE SOLVED: To provide a diffracting optical element which has such constitution that while the performance is held excellent, the manufacture is facilitated and an optical system using the same. SOLUTION: The diffracting optical system 1, constituted by joining a 1st diffracting element 3 and a 2nd diffracting element 4 which are made of mutually different materials together in contact and forming a diffraction grating groove 5 in a specified shape on the join surface between both the diffracting elements 3 and 4, is characterized in that the thickness d1 of the 1st diffracting element 3 and the thickness d2 of the 2nd diffracting element 4 are both≥5.5μm and the minimum pitch (p) of the diffraction grating groove 5 is≥50μm. Further, the optical system is constituted having a cemented lens formed by cementing at least one positive lens and one negative lens together and the diffracting optical element 1.
