PROBLEM TO BE SOLVED: To provide a proton conducting film with a low methanol permeability which is superior in flexibility, has sufficient proton conductivity even at a low water content, and is suitable for DMFC, and a fuel cell using it. SOLUTION: An organic-inorganic hybrid type proton conducting material has a polymer as a precursor having a repetition unit expressed by a general formula (1), and a three-dimensional cross-linked material obtained by a sol-gel reaction of the precursor and a proton source are contained. Here, R<SB>1</SB>and R<SB>2</SB>in the general formula (1) express hydrogen atom or a substituent respectively, X expresses a linking group of single bond or bi-valence, and m expresses an integer of 1 to 5. When m is 2 or more, R<SB>1</SB>and R<SB>2</SB>may be the same or different respectively, or may be mutually coupled and form a ring. At least one of R<SB>1</SB>, R<SB>2</SB>and X contains at least one substituent capable of forming the three-dimensional cross-linked material expressed by -M(Y)<SB>f</SB>Z<SB>g-f</SB>by condensation. M expresses Si, B, Al, Ti, Ta, or Zr, Y expresses an alkoxy group, an aryloxy group, or a halogen atom, Z expresses a substituent, g expresses a number possible to be substituted into M by Y and Z, and f expresses an integer of 1 to g.
