PROBLEM TO BE SOLVED: To provide a management information generating and recording method and apparatus for a digital data stream in which the digital data stream is divided into stream recording units so that maximum search time is made equal by recording units when receiving and recording the digital data stream. SOLUTION: In the method of making equal the maximum search time, a bit rate of the data stream is confirmed, and the data stream is recorded after changing and setting division units (division time units) of stream recording units in accordance with the confirmed bit rate, such that a size of each stream recording unit is divided fixedly regardless of the bit rate of the recording data stream.
