PROBLEM TO BE SOLVED: To provide an image transmission apparatus with excellent subjective evaluation wherein no reproduction is interrupted even when the quality of a communication channel is deteriorated.

SOLUTION: An image supply section is notified of the data amount pooled in a moving picture transmission section due to transmission waiting, and inspects the notified data amount to stop supply of the data of a layer when the data amount reaches an upper limit or over determined for each layer of moving picture codes.
