PROBLEM TO BE SOLVED: To provide a crystalline polyester which can ensure the low-temperature fixability of a toner and can exhibit excellent characteristics in the shelf life property and durability thereof as well when used as a binder resin of the toner and a toner containing the crystalline polyester. SOLUTION: The crystalline polyester which has 5,000 to 10,000 number average molecular weight, 150,000 to 8,000,000 weight average molecular weight, 60 to 150°C in maximum peak temperature of heat of fusion, and 0.6 to 1.3 in the ratio (softening point/peak temperature) of the softening point and the maximum peak temperature of the heat of fusion (softening point/peak temperature) and the toner containing the crystalline polyester as the binder resin are provided.
