PROBLEM TO BE SOLVED: To provide a communication device and a data communication method for detecting configurations, capabilities and limits of various communication channels, related equipment and regulation environments for specifying a specific (xDSL) communication standard suited to existent line conditions. SOLUTION: A negotiation data transmitting part 50(54) transmits a carrier to a response side communication device in cooperation with a plurality of start side communication devices. A negotiation data receiving part 56(52) receives the carrier from the response side communication device in response to the transmitted carrier in cooperation with the plurality of start side communication devices. A selector selects a suitable communication device out of a plurality of communication devices according to the response side communication device in order to set up a communication channel.
