PROBLEM TO BE SOLVED: To provide an optical disk recording and reproducing apparatus for preventing read errors as many as possible even when the recording quality of an optical disk deteriorates, and to provide its recording and reproducing method. SOLUTION: The optical disk 11 having a recording region in the optical disk recording and reproducing apparatus and its recording and reproducing method is provided with a read quality monitoring means 101 for monitoring a degree of difficulty to read in a data block unit at reading; a non-recording region monitoring means 102 for monitoring the size of a non-recording region; a data copying means 103 for copying a data block in which the degree of difficulty to read exceeds a threshold on the recording region; and a copy list managing means 104 for updating a copy list including data region information of a copy origin and a copy destination.
