PROBLEM TO BE SOLVED: To provide a device and a method for identifying a preceding vehicle as a target vehicle in a transient and a non-transient conditions. SOLUTION: In general, to make an estimated position of a target vehicle, this method comprises a step for estimating the position of the target vehicle from the position of an ACC vehicle, a step for creating a time dependent positional trace of the target vehicle, a step for estimating the radius of the positional trace of the target vehicle by applying circular curve fitting to the positional trace of the target vehicle, and a step for judging whether the target vehicle being in a lane of the ACC vehicle by using the radius of the positional trace, the estimated position of the target vehicle and the position of the ACC vehicle.
