PROBLEM TO BE SOLVED: To provide a data transmitting and receiving method for realizing small capacity of a server side while avoiding cases wherein contents can not be distributed because of differences in compression method and specifications of a bit rate between transmission and reception.

SOLUTION: A data receiving device 200 transmits a content ID, a compression method and the ranges of a bit rate to a data transmitting device 400 (S1201). The data transmitting device 400 specifies a compression method and a bit rate and send them to the data receiving device 200 (S1202). The data transmitting device 400 encodes contents by the specified compression method and begins distribution of the contents at the specified bit rate (S1207). If a "bit rate change request" is received from the data transmitting device 200 during this period (S1208), the data transmitting device 400 determines a new bit rate and reports it to the data receiving device 200 (S1210) and restarts distribution of the contents at the changed bit rate (S1213 to S1215).
