PROBLEM TO BE SOLVED: To provide a new binder resin composition for a toner and a toner having excellent basic properties as a toner, such as grindability, fixability, anti-hot-offsetting property and preservability and exhibiting excellent suitability to deinking and whiteness in recycling of used paper. SOLUTION: (1) A binder resin for a toner comprises 3-30 mass% copolymer having structural units of aspartic acid and/or glutamic acid and a hydroxycarboxylic acid and a weight average molecular weight of 1,000-100,000 and 70-97 mass% polyester resin. (2) A binder resin for a toner comprises a urethane modified resin obtained by chain-lengthening a mixture of 3-30 mass% copolymer having structural units of aspartic acid and/or glutamic acid and a hydroxycarboxylic acid and 70-97 mass% polyester resin with a polyisocyanate.
