<p><P>PROBLEM TO BE SOLVED: To perform control according to transmission rate to be demanded for transmission data, etc., and to reduce influences of characteristics degradation due to complication of mutual correlation and multipath fading. <P>SOLUTION: Input data is encoded by an encoding part 1 and its order is replaced by an interleave part 2. A distribution part 3 distributes the transmission data into two systems and a data stream in a first system is outputted to an information modulation part 4. A data stream in a second system is outputted to a spread code selection part 5. A spreading part 6 spreads the data stream in the first system the information of which is modulated by a spread code selected according to a data system in the second system. To the spread code, m candidates for the spread code are allocated among a plurality of candidates for the spread code the code length of which is n and one candidate is selected according to the data system in the second system.
