APPARATUS AND METHOD FOR TRANSMITTING PACKET

PROBLEM TO BE SOLVED: To provide an apparatus for transmitting a packet which can simply and rapidly deal with a protocol with a rate control except a TCP.

SOLUTION: The apparatus for transmitting the packet comprises a flow sorter 8 inputting the arrived packet, sequentially outputting the not discarded packet to an external unit and sorting the arrived packet at each flow; a flow judging unit 9 for judging whether each flow is in a range of a using band decided by its upper limit band or not; and an upper limit band updating unit 10 for updating the upper limit band by referring to the judgment result of the flow deciding unit. In this apparatus, the upper limit band updating unit might update the upper limit band so as to become the upper limit band exceeding a value obtained by dividing a channel capacity by the number of flows.
