PROBLEM TO BE SOLVED: To multiplex a plurality of elementary streams ES independently of the capacity of a main buffer (MB) of the Program System Target Decoder (P-STD). SOLUTION: The program stream multiplexing apparatus is provided with a pack selection circuit 71 for managing the state of the memory occupied amount of a VMB 204 for storing a video ESVS of the P-STD and AMB 207, 209 for storing audio ESAS1, AS2, discriminating multiplex precedence and multiplexing discrimination to multiplex the video ESVS and audio ESA1, AS2 in the order of the VMB 204 and the AMB 207, 209 which get free so as to control the multiplexing. The apparatus manages the state of the MB and multiplexes the ES in the order the MB getting free when multiplexing a plurality of ES to attain multiplexing without causing underflow to the MB even when the ES with the same MB capacity is multiplexed.
