PROBLEM TO BE SOLVED: To obtain an occupant detecting device which can reduce the height of a sensor main body and enables cost reduction. SOLUTION: The occupant detecting device is equipped with luminous radiation means 21a-21h for casting lights in the almost horizontal direction, beam forming means 22a, 22b for turning the lights which the means 21a-21h cast into a parallel light beam or convergent light beam in the almost horizontal direction, downward reflection means 23a, 23b for reflecting the light beam toward a downward seat vicinity direction, and light receiving means 24a, 24b for detecting a state of the occupant by the incidence of an optical beam which collides against the occupant and is scattered.
