PROBLEM TO BE SOLVED: To provide an optical element which has spectral performance of high efficiency by utilizing only the band light of a higher order by using a one-dimensional photonic crystal and a spectral apparatus using the same. SOLUTION: The end face of the one-dimensional photonic crystal 1 is provided with phase modulating means 8 which imparts the phase modulation of the same period and direction as those of the photonic crystal 1 to incident light 3. Only the specific higher order band light is propagated within the photonic crystal, by which the intensity of exit light 6 from the surface of the one-dimensional photonic crystal is intensified, i.e., the efficiency of utilizing the incident light is improved. Also, the exit light 6 is allocated to one side or both sides of the photonic crystal and the intensity is regulated by the effect of a structure 12 added to the photonic crystal.
