<P>PROBLEM TO BE SOLVED: To provide a network MPEG encoder capable of transmitting a bit stream so as to prevent the system employing the network MPEG encoder from being inoperative. <P>SOLUTION: A CPU 12 calculates a bit rate (d) of data transmitted in an Ethernet 3 by using the number of total data transfer to a memory 13 at two each time after a time of application of power. When starting encoding by an MPEG encode section 14, the CPU 12 discriminates whether or not a sum of a bit rate (c) preset in the MPEG encode section 14 and the bit rate (d) reaches a critical bit rate.
