PROBLEM TO BE SOLVED: To provide an information recording and reproducing device and an information transmission/reception system or the like capable of preventing illegal copying while permitting backup of downloaded or purchased contents data.

SOLUTION: The information recording and reproducing device is configured to comprise: a storage means having an encrypted contents data recording area and a recording area for identification data being a key to encryption and decoding of the contents data which cannot be read, recorded or rewritten by an ordinary user operation; and a recording and reproducing means for backing up the original identification data to other storage means under the condition of disabling reuse of the original identification data.
