PROBLEM TO BE SOLVED: To provide a copy protection system for easily and strongly preventing unauthorized copying without using a complicated ciphering system for a disk recording and playback medium capable of recording and playback. SOLUTION: A disk recording and playback device is provided with a data recording and reproducing means for recording and reproducing data by the unit of 1 ECC block constituted of a plurality of sectors to a data area and forming an alternate sector for the defective sector of the data area in another part excluding the defective sector of the data area, and a defect managing means for managing the number of the defective sectors, the addresses of the defective sectors and the addresses of the alternate sectors in a defect managing area. The defect managing means manages a prescribed normal sector as the defective sector and the recording and reproducing means records normal data in the prescribed normal sector turned to the defective sector and records dummy data different from the normal data and not generating an ECC error in the alternate sector.
