PURPOSE: A toner composition comprising the polyester particle encapsulating wax for the development of electrostatic latent image and its preparation method are provided, to prepare an oil-free toner composition having an excellent fluidity without the polymerization process. CONSTITUTION: The toner composition comprises a coloring agent; 70-98 wt% of a polyester resin; a charge control agent; 0.01-30 wt% of a wax, wherein the wax is encapsulated in the polyester resin particle. Preferably the wax is selected from the group consisting of ester wax, carbauna wax, polyethylene wax, polypropylene wax and bees wax; and the polyester resin is an amorphous resin, has an average number molecular weight of 2,000-10,000, and optionally contains a functional group capable of reacting with a functional coloring agent. The composition has a volume average particle size of 2-10 micrometers and is spherical shaped.
