PROBLEM TO BE SOLVED: To provide an upper surface emission type light emitting device wherein a positive electrode formed on the upper side of an organic compound layer is implemented as a light take-out electrode in an active matrix light emitting device. SOLUTION: The light emitting element comprising a negative electrode, the organic compound layer and the positive electrode is characterized in that a protection body is formed on an interface between the positive electrode served as the light take-out electrode and the organic compound layer. The protection body formed on the organic compound layer has 70 to 100% transmission factor, preventing damage applied to the organic compound layer when the positive electrode is deposited by a sputtering method.
