PURPOSE: A touch panel and the producing method thereof are provided to increase the optical permeability and the brightness. CONSTITUTION: A lower substrate receives light from a display device. A lower substrate(43) has the same optical axis as the optical axis of the lower substrate. A first electrode(36A) is formed on an upper substrate(44). A second electrode(36B) is formed on the lower substrate to be crossed to the first electrode. A spacer is formed between the upper substrate and the lower substrate. The upper substrate and the lower substrate are a PET(Polyethylene Terephthalate). Thereby, the optical loss via the upper substrate of a touch panel from the lower substrate is minimized by confirming the optical axes of the upper substrate and the lower substrate.
