PURPOSE: A device of transmitting data in a mobile communication system and a method thereof are provided to simplify a CFN(Connection Frame Number) checker necessary for adjusting synchronization by using a CFN of a frame protocol and a CFN of a frame protocol of the next data, thereby efficiently implementing an asynchronous macro diversity. CONSTITUTION: A CFN checker(32a) sequentially inputs output FPs(Frame Protocols) of many base stations(31), compares whether CFNs of frames are the same, and checks synchronization. A CRC(Cyclic Redundancy Check) and CRCI(Cyclic Redundancy Check Indicator) checker(32b) checks whether any change is made as output data of the CFN checker(32a) is transmitted, and outputs data only except changed data. A QE checker(32c) transmits data having the least error rate among the output data of the CRC and CRCI checker(32b) to an upper end.
