PROBLEM TO BE SOLVED: To provide a device for discriminating an information recording medium for discriminating the kind of at least two kinds of information recording media having different distances from the surface of the information recording medium to the information recording surface whereon the recording information is recorded. SOLUTION: This device for discriminating the information recording medium discriminates the kind of at least two kinds of information recording media having different distances to the information recording surface, and is provided with a judging means for: detecting a measurement value of the time starting from the appearance of a first focus error signal, etc., obtained by moving an objective lens from a specified position with respect to the recording medium, a movement value from the specified position of the objective lens and a focus driving voltage value; and comparing the detected values with a set stipulated time measuring value, a stipulated moving value and a stipulated focus driving voltage value.
