PROBLEM TO BE SOLVED: To provide an electronic watermark embedding apparatus capable of easily identifying a leaked path when digital data are illegally leaked, and to provide a file server comprising the apparatus, a network data server and a data distribution system. SOLUTION: The electronic watermark embedding apparatus includes an input means 4 for receiving digital data, a counter 6 for receiving an input start signal to output identification information, and an electronic watermark embedding means 8 for outputting embedded digital data formed by embedding the identification information to the digital data, and the counter 6 receives the input start signal and generates a different ID every time.
