PROBLEM TO BE SOLVED: To provide a fixing device and an image forming apparatus capable of accurately detecting temperature. SOLUTION: In a fixing unit having constitution where a conductive resistance layer does not exist at the center of a heater base plate and constituted so that a temperature detecting element and an excessive temperature rise preventing element are externally attached and made to press-contact with the heater base plate, the temperature detecting element and the excessive temperature rise preventing element are attached to a heater base plate holding member by using a position adjusting member so that the temperature detecting element and the excessive temperature rise preventing element can follow up a heater even when the heater is warped due to the difference of the thermal expansion of the heater by energizing the conduction resistance layer. Even though the fixing unit has constitution that the temperature detecting element and the excessive temperature rise preventing element are positioned with respect to the heater base plate holding member by an energizing member, the same follow-up effect is obtained.
