PROBLEM TO BE SOLVED: To provide a radio data communication system, in which a base station carries out modulation of OFDM system by using the same frequency band as that of an adjacent base station, and to provide a radio data communication method and its program. SOLUTION: In the radio data communication system, employing a plurality of base stations each making communication with a mobile station by adopting the OFDM system for the modulation system, a transmission power control processing section 23 of the base station controls each sub channel for transmission with arbitrary transmission power. A wireless communication processing section 22 uses one or a plurality of sub channels to condnet communication with a mobile station. A data control processing section 24 applies packet multiple access to the mobile station, by using communication data comprising a plurality of packets, each of which includes access control information used for controlling the access.
