PURPOSE: An apparatus and a method for writing digital data streams, and a recording medium according to the same are provided to minimize the number of A/V packs, thereby preventing data record capacity of a recording medium from reducing, and normally executing a track play operation requested by a user. CONSTITUTION: An apparatus for writing digital data streams includes a source data detecting part(14) detecting a type of source data received from the outside, a bit rate detecting part(13) detecting bit rate of the source data, a recording signal processing part(11) variably dividing the size of A/V packs by HOB according to the detected bit rate or type to process recording signals, an optical pickup(10) writing the signal-processed data at a high density DVD(100) in pit patterns, a control part(12) controlling operations of the parts.
