PROBLEM TO BE SOLVED: To irradiate nearly all of recordable regions of a second information recording layer with a light of uniform intensity without using an intricate recording and reproducing system even when the transmittance of the light in the recordable regions of the first information recording layer on a light incident side varies according to whether the recordable regions are already recorded or not. SOLUTION: The optical recording and reproducing device makes the light for recording and reproducing incident on the optical disk 1 which is laminated with the plural information recording layers and are capable of recording and reproducing independent information relating to the respective information recording layers from one surface side by photoirradiation means. In such a case, the optical recording and reproducing device is so controlled as to perform recording or reproducing relating to the recordable region of the recordable regions 3 of the second recording layer 8 after the recording relating to the entire region of the recordable regions 3 of the first recording layer 10 on the light incident side of the optical disk 1 is completed.
