PROBLEM TO BE SOLVED: To provide a new promoter that functions in a plant and has an ability comparable to CaMV35S promoter. SOLUTION: A DNA having the base sequence shown by sequence no.1 (see Specification), a DNA consisting of the base sequence from 1st base to 1243rd base in the base sequence shown by sequence no.1 (see Specification) or a DNA that hybridizes to these DNAs under stringent conditions and has a promoter activity in a plant cell, is used as promoters.
