PROBLEM TO BE SOLVED: To provide a highly reliable fixing device realizing optimal paper passing speed even in the case of using a sheet of a minimum size width, and also surely preventing over-rising of temperature by surely detecting a temperature of a fixing heater, and to provide a picture forming device. SOLUTION: When a voltage value (Vth1a) of a thermistor 38 (TH1) is detected and Vth1a takes a voltage value lower than reference voltage (Vref1), print speed of the sheet is controlled slower, and when a voltage value of the thermistor 38 (TH1) is detected and Vth1b takes a voltage value lower than a reference voltage (Vref2), it is judged as an abnormally high temperature, and the fixing heater 30 (H1) is shut off from energizing.
