PROBLEM TO BE SOLVED: To provide a compact and simply composed diffractive optical element of which the diffraction efficiency is excellent in a broad band of a visible light region or the like, an optical element having the diffraction optical element, an optical system, a photographing device, and an observation device. SOLUTION: The diffraction optical element is composed of an optically transparent optical material in which a first region, a second region, and a third region which have a relievo pattern are tightly or closely arranged. The diffraction optical element is characterized in that the absolute values of height of the relievo pattern in at least two of the three regions are equal and the directions of the relievo pattern are reverse.
