PROBLEM TO BE SOLVED: To provide an occupant determination device that can suppress an erroneous occupant determination due to an effect of rocking or the like in vehicle travel. SOLUTION: The occupant determination device 20 comprises load sensors 21 to 24 arranged on a seat body 1, and a controller 25 for calculating a detection load value S as the sum of output load values by the load sensors 21 to 24. The controller 25 executes an occupant determination according to a magnitude relation between the detection load value S and a given determination threshold value A. If a variationΔin the detection load value S is not larger than a given value D when the magnitude relation between the detection load value S and the given determination threshold value A changes, the controller 25 prohibits a changeover in the occupant determination due to the change in the magnitude relation between the detection load value S and the given determination threshold value A.
