PROBLEM TO BE SOLVED: To provide a stapler capable of securely resetting a binding means into a waiting position range and smoothly performing the binding even if the binding speed of the stapler is increased in response to the processing speed of a system device, in which the stapler is to be assembled. SOLUTION: As a sensor for catching the timing of starting the stop operation of a driving motor MO, in addition to a waiting position sensor SE1, an operation position sensor SE2 for detecting the operating position of the binding means and capable of starting the stop operation of the driving motor MO with a timing that a closing means is reset into a waiting position range is provided. Output of the waiting position sensor SE1 or the operating position sensor SE2 are selectively used. When assembling this stapler device in the system device, the sensor positioning nearest and capable of resetting the binding means into the waiting position range under the severest condition of the system device is previously selected, and the output of the sensor is controlled to securely reset the binding means into the waiting position range.
