SOLUTION: The information recording and reproducing device to record/ reproduce information to/from the information recording and reproducing medium having a data area being a predetermined recording area, a spare area and a defect list, is provided with a means that manages a occurred defect in the unit of sectors that is a unit of recording and reproducing and the information recording and reproducing device discriminates whether or not a medium is an illegally copied information recording and reproducing medium by registering a normal sector to be intentionally registered as a defective sector (provision of a hidden sector).
